The International model
Instead of proceeding with filing a national design or model, or in addition to it, you can file an International model with a single procedure managed by the WIPO of Geneva. It is possible to file a unique model or a series of models up to 100, by attaching to the application photographs or drawings of the items that need protecting. The cost varies according to the number of countries and the format of the attached models.
[Deposit types]
This is a rather complex procedure that provides for 7 deposit types, amongst which the following:
- Deposit governed exclusively by the 1934 Act: this is either because the depositor is a citizen of a country bound only by this Act, or because, even though he is a resident of a country which has undersigned both the Acts, only designates those countries bound by the 1934 Act;
- Deposit governed exclusively by the 1960 Act: this occurs either because the depositor is a citizen of a country bound by only part of this act, or because, even though he is a resident of a country which has undersigned both the Acts, designates only those countries tied to the 1960 Act and has renounced the effects of the deposit in the countries bound by the 1934 Act;
- Deposit governed in part by the 1960 Act: this is when the depositor is a citizen of a country which has undersigned both the Acts and designates countries which are bound by the 1960 Act without renouncing the effects of the deposit in the countries associated to the 1934 Act.
Italy has only joined the 1960 Act therefore point n. 2 is applied.
[Method of deposit]
A single deposit can be made with the WIPO of Geneva and it is not necessary to have previously deposited the same model in Italy. It is however possible to claim the priority, if an Italian registration exists, within 6 months.
The International model has the same effect of a national registration in every country designated in the deposit. The contracting countries may refuse protection by sending a communication to the WIPO within 6 months from publication, but the owner can lodge an appeal.
All International deposits governed only by the 1960 Act are effective for 10 or 15 years, according to the law of each country: initially the fees will be paid for 5 years, thereafter once or twice for any additional period of five years.
The official languages of this procedure are French and English.
The countries bound by this Act are 42, as at 26th April 2005, but not all of these have undersigned the 1960 Act, of which Italy is part of, and, therefore, they cannot be designated.
The 1999 Act of Geneva has been introduced in some countries and, once extended to all the states, should guarantee greater protection.
The list of the countries varies all the time according to the different Acts. The one listed hereunder and updated to July 2005, is an overall indication of the states where is possible depositing an International model.
